Soil Relocation Agreements

Ecowaste operates the Richmond Landfill under the terms of Operational Certificate MR-04922. This permit authorizes the disposal of soil including "industrial quality soil" and "waste soil". According to MR-04922 (Subsection 2.8):

"industrial quality soil" means soil which has been relocated from any site, contains one or more substances with concentrations exceeding the applicable numerical soil standards for agricultural land, but contains no substances with concentrations exceeding the applicable numerical soil standards for industrial land; and

"waste soil" means soil which has been relocated from a contaminated site, contains one or more substances with concentrations exceeding the applicable numerical soil standards for industrial land, and is not classified as special waste.

MR-0499 (Subsection 1.5) further authorizes the treatment and short term storage of hydrocarbon contaminated soil up to the following limits

Total benzene, 25. mg/kg, maximum;
Total ethylbenzene, 250. mg/kg, maximum;
Total toluene, 150. mg/kg, maximum;
Total xylenes, 250. mg/kg, maximum;
VPH,2 2 500. mg/kg, maximum;
LEPH,3 25 000. mg/kg, maximum;
HEPH,4 70 000. mg/kg, maximum

Notes:
2 "VPH" means volatile petroleum hydrocarbons, excluding benzene, ethylbenzene, toluene and xylenes.
3 "LEPH" means light extractable petroleum hydrocarbons, excluding polyaromatic hydrocarbons.
4 "HEPH" means heavy extractable petroleum hydrocarbons, excluding polyaromatic hydrocarbons.

Bill 26, the Waste Management Amendment Act, 1993, subsection 20.81 Contaminated soil relocation states:

"Subject to subsection (5), no person shall relocate contaminated soil from a contaminated site without (a) entering into a contaminated soil relocation agreement, and (b) complying with terms and conditions of the contaminated soil relocation agreement."

Subsection 5 states:

"(5) Nothing in this Part prevents a person from depositing soil from a contaminated site at another site where the deposit is authorized by (a) a valid and subsisting permit or approval . . . "

Ecowaste has therefor concluded that acceptance of soil meeting the terms and conditions of our Operational Certificate can be done without a "Contaminated Soil Relocation Agreement".
